This Agreement contains the complete terms and conditions that apply to your participation as a member of the Genbucks Affiliate Program (the “Program”) operated by Genbucks (hereinafter, “Company,” “we” or “us). As used in this Agreement, “you” or “your” means the applicant/participating member.
You must read, agree to, and accept the terms and conditions contained in this user agreement before you may participate in our affiliate program.
1. Spam
We do not accept any traffic from spam, this includes unsolicited bulk emailing, and IM spamming (icq etc.). Any affiliate spamming will be cancelled and all earnings will be revoked. Please contact us with details and wait our approval before sending any opt-in campaigns.
GENBUCKS accepts all forms of traffic, except for traffic coming from Illegal sites, such as bestiality and child porn etc, nor do we accept traffic coming from fraudulent means or spam.
GENBUCKS will send payment via, Epassporte, Stormpay or wire for the applicable commissions every Friday, with no holdback (except for orders that are pending fraud reviews). Please email us your wire information if necessary. Minimum payments are $100 for Epassporte or $1000 for wire payments. For any affiliate who doesn't make the minimum, the commission will be carried over until the minimum has been reached unless payment has been requested. A wire sent under $1000 will incur a $30 fee, wires above $1000 are free. We will never deduct any orders from your sales, for returns, refunds, charge backs etc. We pay all these from our own pockets. The commission rates are usually 40% of the total sales amount and 4% and 1% of all your referrals sales. We place a non expiring cookie on your customers computer so you also get credited for all reorders.
We also will pay $1 referral commission bonuses on all raw affiliate recruitment. You will not get $1 referral bonuses from these countries. (you will still however get commissions on any sales they or their downline makes).
We reserve the right to block any affiliate from receiving $1 referral bonuses, and in cases of fraud ban them without pay from the program, this would happen is such cases of higher than normal inactive or fake signups. We will not pay for affiliates recruited from paid to signup programs, or other means where affiliates joining will never have any intention of promoiting the program.
Customers who purchase products and services through an Affiliate will be deemed to be customers of GENBUCKS . Accordingly, all GENBUCKS rules, policies, and operating procedures concerning customer orders and service will apply to those customers. We may change our policies and operating procedures at any time. Prices and availability of our products and services may vary from time to time. GENBUCKS policies will always determine the price paid by the customer.
GENBUCKS reserves the right not to accept any site or person into the Affiliate Program based on any reason we choose. We also have the right to terminate any Affiliate we choose for whatever reason. In such circumstances the affiliate will be paid upto the date of account cancellation, unless they were committing fraud, and in that case there details will be passed to appropriate Authorities, and all earnings voided.
6. Relationship of Parties
GENBUCKS and the affiliate are independent contractors, and nothing in this Agreement will create any partnership, joint venture, agency, franchise, sales representative, or employment relationship between the parties. You will have no authority to make or accept any offers or representations on our behalf. You will not make any statement, whether on your site or otherwise, that reasonably would contradict this statement.
7. No Warranties
GENBUCKS makes no warranties of any kind, whether express or implied, with respect to the affiliate program. GENBUCKS is in no way responsible for damages suffered by any customer, including incidental damages or lost profits. This includes loss of data resulting from delays, non deliveries, misdeliveries, system failures or service interruptions caused by any source whatsoever. GENBUCKS makes no representation that the operation of our site or the Affiliate Sites will be uninterrupted or error free, and we will not be liable for the consequences of any interruptions or errors. All content in the GENBUCKS software and affiliate program is provided to you "as is" without warranty of any kind either express or implied including, but not limited to, the implied warranties of merchant ability and fitness for a particular purpose, title, non infringement, security or accuracy.
